1. Scope and acceptance
By accessing or using Haya, you agree to these Terms and the Privacy Policy. If you act for a company, you confirm that you are authorized to represent it. These Terms remain subject to applicable Saudi law and any signed commercial agreement.
2. Eligibility and account information
Users must be at least 18 years old, provide accurate and current information, protect their sign-in credentials, and promptly report suspected misuse. Haya may request identity, company, banking, product, or compliance documents before activating features or approving a relationship.
3. Platform roles
Freelancers act independently and are not Haya employees unless a separate written agreement says otherwise. Vendors remain responsible for their products, prices, stock, delivery, warranties, licences, taxes, and documents. Haya may review, approve, reject, pause, or remove accounts, vendors, products, quotations, or orders to protect the platform and its users.
4. Orders, commission, and payment
Commission rates, eligibility, payment timing, deductions, returns, and early-payout options are determined by the applicable offer shown in Haya and any signed agreement. Illustrations and examples are not guaranteed earnings. Commission is payable only after the underlying transaction and required payment conditions are confirmed. No payment method is promised unless Haya expressly activates and communicates it.
5. Acceptable use
You must not provide false information, impersonate others, misuse personal data, interfere with security, submit unlawful or misleading content, manipulate prices or commissions, create duplicate or fraudulent accounts, or use Haya in a way that violates applicable law or third-party rights.
6. Content and communications
Haya and its licensors retain rights in the platform, brand, design, and software. You keep rights in content you submit but authorize Haya to host, review, process, and share it as needed to operate the requested service. Operational messages may be sent by email, phone, or WhatsApp; marketing messages will follow the applicable consent requirements.
7. Suspension, availability, and liability
Haya may suspend or terminate access for security, legal, fraud, non-payment, inaccurate information, or material breach reasons. The platform may change or be temporarily unavailable. To the extent permitted by law, Haya is not responsible for indirect losses or matters controlled by vendors, freelancers, clients, banks, carriers, or other third parties. Nothing in these Terms excludes liability that cannot legally be excluded.
8. Governing law and contact
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Parties should first try to resolve disputes in good faith; unresolved disputes may be submitted to the competent Saudi courts unless a valid written agreement provides another lawful process.
